KEDUDUKAN KOMPILASI HUKUM EKONOMI SYARIAH (KHES) DALAM BISNIS SYARIAH DI INDONESIA

Abstract

The birth of the Compilation of Sharia Economic Law (KHES) began with the issuance of Law No. 3 of 2006 concerning Amendments to Law No. 7 of 1989 concerning Religious Courts. Law No. 3/2006 expands the authority of the PA in accordance with legal developments and the needs of Indonesian Muslims today. The birth of this law has major implications for legislation governing property, business and trade at large. The position of the Compilation of Sharia Economic Law (KHES) in sharia business in Indonesia complements the pillars of the Religious Courts and KHES as a guide to sharia business in Indonesia. The position of the Compilation of Sharia Economic Law (KHES) in the order of positive law in Indonesia has gained legitimacy as a statutory regulation in Indonesia and can be used as a reference or legal umbrella in adjudicating and resolving sharia economic disputes in the Religious Courts.
